⚖️ Terms and Conditions of Service

NOTE: The following document includes the previously agreed-upon clauses PLUS new, essential clauses (highlighted by bold headings) necessary for a robust real estate marketplace operating in Bangladesh.


 

1. DRUTOO's Role as a Platform

 

DRUTOO is a digital marketplace and listing platform. We provide a technology service that connects Property Seekers (buyers and renters) with Property Owners (individuals, agents, and developers) who list properties for sale or rent in Bangladesh.

 

1.1 Disclaimer of Ownership and Liability

 

DRUTOO IS NOT A PROPERTY OWNER, SELLER, LANDLORD, OR REAL ESTATE BROKER.

  • No Ownership: DRUTOO has nothing to do with the ownership of the property listed on the Platform.

  • No Agency: We are not agents for any user. Any agreement for sale, rent, or lease is strictly between the Property Seeker and the Property Owner.

  • Listing Accuracy: While we strive for accuracy, DRUTOO does not guarantee the quality, safety, legality, or truthfulness of any listing information. Users are solely responsible for conducting their own due diligence, including property inspection, legal review, and financial assessment before entering into any transaction.


 

2. Property Viewing Commitment and Booking Fee (Tk 100 Max)

 

 

2.1 Viewing Commitment

 

When a Property Seeker uses the Platform to book a viewing or physical visit for a listed property, the user is making a commitment to attend that scheduled visit.

 

2.2 Introduction of the Minimum Fee

 

DRUTOO will soon introduce a minimum, non-refundable booking fee for scheduling property viewings.

  • Fee Limit: This fee will not exceed BDT 100 (One Hundred Bangladeshi Taka).

  • Payment: Users will be required to pay this fee at the time of booking confirmation using available Mobile Financial Services (MFS) like bKash or a Card payment.

  • Purpose: The fee covers administrative costs and confirms the user's sincere intent.


 

3. Listing and Transaction Details (New Essential Clauses)

 

 

3.1 Listing Vetting and Removal

 

DRUTOO reserves the right, but is not obligated, to vet and remove any listing at any time that is deemed false, misleading, illegal, or that violates these Terms. Listing removal may occur without prior notice to the Property Owner.

 

3.2 Property Owner Responsibilities

 

Any user posting a property for sale or rent warrants that:

  • They are the legal owner of the property or have the valid authority and necessary permissions to market the property.

  • The listing information, including price, size, photos, and legal status (e.g., khatian details, mutation records), is accurate, truthful, and complete.

  • The property is free from undisclosed encumbrances, disputes, or illegal construction according to relevant Bangladeshi laws and municipal codes.

 

3.3 Financial Transparency

 

All financial figures (e.g., price, rent, service charges) must be clearly stated in the local currency (BDT) and include all mandatory applicable taxes or fees required by the Government of Bangladesh, or clearly state if taxes are to be added. DRUTOO is not responsible for any subsequent financial disputes between transacting parties.

 

3.4 Force Majeure Clause

 

DRUTOO shall not be liable for any failure or delay in performance under these Terms for causes beyond its reasonable control, including but not limited to, acts of God, natural disasters, war, terrorism, civil disturbances, strikes, power outages, internet failures, or any government action or regulation specific to the real estate sector in Bangladesh.


 

4. User Accounts and Conduct

 

 

4.1 Account Registration

 

You agree to provide accurate, current, and complete information during the registration process.

 

4.2 Prohibited Conduct

 

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any local, national, or international law, including the laws of Bangladesh.

  • Post false, misleading, or deceptive information.

  • Harass, intimidate, or threaten any DRUTOO agents or other Platform users.


 

5. Disclaimers and Limitation of Liability (Expanded)

 

 

5.1 No Warranty for Transactions

 

DRUTOO does not warrant or guarantee that a Property Seeker will find a suitable property or that a Property Owner will successfully sell or rent their property. The ultimate success of any transaction depends solely on the actions of the users.

 

5.2 Limitation of Liability

 

To the maximum extent permitted by the law of Bangladesh, DRUTOO shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, resulting from the use or the inability to use the Platform, including but not limited to damages arising from property defects, legal disputes, or fraud committed by third-party users.


 

6. Intellectual Property

 

The name DRUTOO, the logo, and all content on the Platform are the proprietary property of DRUTOO PROPERTIES.


 

7. Termination

 

DRUTOO reserves the right to suspend or terminate your access to the Platform at its sole discretion, without notice, for any violation of these Terms.


 

8. Governing Law and Dispute Resolution

 

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising out of these Terms or use of the Platform shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the competent courts in Dhaka, Bangladesh.


 

9. Changes to Terms

 

DRUTOO reserves the right to modify or replace these Terms at any time. Your continued use of the Platform after the effective date of the new Terms constitutes your acceptance of the changes.
